FREE LEGAL ADVICE: Legal aid is available on a non means tested basis for all cases where you are to be interviewed by the police

LEGAL AID: Legal aid is available for all cases
brought against individuals in either the Magistrates or Crown Court. In
order to be entitled to legal aid you must demonstrate:
 
(1) INTERESTS OF JUSTICE TEST: It must be shown that the case is of
such significance that you require representation by a lawyer. Examples
include that the case demands the expert cross-examination of a
prosecution witness or that if convicted you face a possibility of a
custodial sentence.
 
(2) MEANS TEST: You must satisfy a means test [as to both income and
capital]. This is complex and we can advise you in more detail but you
will be passported and automatically eligible if:
You are in receipt of a qualifying welfare benefit e.g. Income
Support, Job Seeker’s Allowance, Employment Support Allowance or
Pensions Credit.
You are under 18 years of age
There is a means test calculator available on the Legal Aid Agency website at www.justice.gov.uk/legal-aid
 
FIXED FEES: We are able to act on fixed fees in some
cases. We will need to agree the fixed fee with you depending upon the
facts of each case.
